The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 121, 121(A), 386, 387, 120(B) of the Indian Penal Code and Section 4/5 of Explosive Substance Act and 10/13/16 of Unlawful Activities Substance Act which is pending in the learned court below.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner was not present on the date of occurrence he was already in judicial custody in connection with another case. He submits that nothing recovered from the conscious possession of the petitioner. He

Patna High Court CR. MISC. No.69347 of 2022(2) dt.24-01-2023 2/2 submits that the alleged three cane bomb and 12 detonator was seized from the house of the co-accused Umesh Thakur and Sri Ram Thakur. He further submits that petitioner has got one criminal antecedent as stated in para-3 of the bail application. Per contra, learned APP for the State vehemently opposing the bail application and submitted that the petitioner is also involved in the present case. Hence, he does not deserve anticipatory bail.

Considering the facts and circumstances of the case and the fact that petitioner is a member of the Maowadi Sangathan and he is also involved in the present case,I am not inclined to enlarge the petitioner on bail in connection with Nasariganj (Rajpur) P.S. Case No. 22/2013. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
