JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 420 of the Indian Penal Code and sections 63 and 65 of the Copy Right Act. Prosecution case is that the petitioner used to supply fake TATA salt to the shopkeepers.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case on the basis of statement of shopkeeper, who is one of the co-accused in this case and from whose shop fake salt was recovered. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the
Patna High Court CR. MISC. No.71248 of 2022(2) dt.21-03-2023 2/2 recovery of fake salt. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Siwan in Aandar Police Station Case No. 96/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
