The petitioner is in judicial custody in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Allegedly, it is a case of recovery of 37 liters of illicit liquor from a hut.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor and the hut and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody since 27.06.2022.

No.69301 of 2022(2) dt.06-01-2023 2/2 Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No.II, East Champaran, Motihari in connection with Pipra P.S. Case No. 37 of 2022.
