The petitioner apprehends his arrest in Khaira P.S. Case No. 05 of 2004 instituted for the offence under Section(s) 147, 341, 323, 307 of the Indian Penal Code. There is specific allegation in the written report against this petitioner of assaulting the informant with Tangi on his head. The injury report has been annexed as Annexure-2 wherein the doctor has found two lacerated wound on the scalp of the informant, all by sharp cutting weapon and hard and blunt substance, wherein the opinion has been kept reserve till x-ray report.
In such circumstances, the injury report itself
Patna High Court Cr.Misc. No.8237 of 2017 (2) dt.27-02-2017 2/2 reflects that there is repetition of blow by the petitioner on the head of the informant. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail. The prayer of the petitioner for anticipatory bail is rejected.
The petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Khaira P.S. Case No. 05 of 2004 and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by the order of this Court. (Sanjay Priya, J) Shageer/- U T
