The petitioners seek bail in Turkauliya P.S. Case No. 364 of 2016 instituted for the offence under Section 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and section 27 of the Arms Act.

As per written report, petitioner no.3 assaulted the informant with Farsa on the head, causing bleeding injury. There is allegation against petitioner no.1 of making firing on Kanhaiya but it did not hit him. There is no allegation of specific overt act against petitioner no.1.

The injury report of the informant is annexed as

Patna High Court Cr.Misc. No.8747 of 2017 (2) dt.16-03-2017 2/2 Annexure-3 series wherein the doctor has found simple injury on his person caused by sharp cutting object.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Turkauliya P.S. Case No. 364 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioners.
