JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Turkauliya P.S. 484/2018, registered for offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and sections 30(a), 38(1), 41(1) of the Bihar Prohibition & Excise Act.

Allegation is of recovery of more than 2000 litres of spirit from the house of petitioner and from the van of petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated in the case which will appear from the fact that no compliance of section 100 Cr.P.C. has been made in this case. He has no criminal antecedent and he is in custody since 01.08.2018.

No.65398 of 2018(2) dt.20-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 484/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
