The petitioner seeks bail in Bhagwanpur P.S. Case No.166 of 2018 registered for the offence under Section 30(A) of Bihar Prohibition and Excise Act.

Accusation is that on receipt of secret information about selling illicit liquor by Nitish Choudhary inside the State Tubewell room situated in village-Manopur, the informant along with other police personnel reached there and on search 48 bottles each containing 180 ml. and 24 bottles each containing 375 ml of Royal Stag wine were recovered and the petitioner was also apprehended on disclosure of his name by the co-accused Nitish. Submission on behalf of the petitioner is that petitioner is in custody since 31.08.2018 having no criminal antecedent.

Patna High Court Cr.Misc. No.62388 of 2018 (2) dt.06-10-2018 2/2 Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai, in Bhagwanpur P.S. Case No.166/18.
