2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 413, 414, 467, 468, 471/34 of the Indian Penal Code.
3. As per allegation in the FIR, on getting secret information about keeping of two stolen motorcycles for sale in petitioner's house, police party proceeded towards his house and seized the said motorcycles and thereafter FIR was registered against the petitioner and he was arrested on spot.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The alleged motorcycles are not the stolen property rather the same belong to his friends, who have gone to Gopalganj by car and
Patna High Court CR. MISC. No.71833 of 2023(3) dt.31-01-2024 2/2 parked their motorcycles at petitioner's house on faith. He has no knowledge about the owner of the motorcycles, which were parked by his friends. Petitioner is languishing in judicial custody since 28.7.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bairiya P.S.
