2. The petitioner is accused in a case of murder but from the impugned order, it appears that the bail application of the petitioner was rejected on the initial stage of investigation and neither the learned counsel for the petitioner nor the learned counsel for the informant are having any knowledge about the materials which are against the petitioner.

3. In these circumstances, this application is permitted to be withdrawn by the learned counsel for the petitioner with a liberty to the petitioner to file a fresh bail application before the concerned Court below. If such an application is filed then the Court below will examine the case diary and thereafter pass a

Patna High Court CR. MISC. No.70242 of 2025(2) dt.08-10-2025 2/2 reasoned order in accordance with law.

4. The Court below, while considering the bail application of the petitioner, will not be prejudiced by the fact that the present bail application has been permitted to be withdrawn by this Court.
