Petitioner, who is in custody, seeks bail in connection with Bathnaha P.S. Case No. 217 of 2018 registered for the offences punishable under Sections 420/34 of the Indian Penal Code and under Section 7 E.C. Act.

Informant has stated that on receiving secret information he along with SDO Sadar and SDPO Sadar raided a truck and seized 400 bags of wheat and there on the disclosure of the truck driver 47 bags of wheat and 558 bags of rice were recovered from the godown of Umesh Bhagat.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He is a business man of grains

Patna High Court Cr.Misc. No.62890 of 2018(2) dt.11-10-2018 2/2 and he purchased grain from the farmers and supply it to the different places. On similarly placed co-accused, namely, Ram Nivas Trivedi, has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 58819 of 2018 vide order dated 26.09.2018. He has no criminal antecedent. He is in custody since 20.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 217 of 2018.
