JUSTICE SANJAY PRIYA ORAL ORDER 05-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mushahari P.S. Case No. 115 of 2018 instituted for the offence under Sections 452, 354B, 380 and 511 of the Indian Penal Code.

In the written report it is alleged that on 23.05.2018 at about 12:30 p.m. while three daughters of informant were sleeping in the house, petitioner entered into the house of the informant and tried to commit illegal act with 13 years old daughter of the informant by molesting her breast. She cried, upon which, two sisters of the victim girl got awake. Thereafter, the informant and his wife came, but petitioner managed to run away.

Counsel for the petitioner submits that informant is not

Patna High Court Cr.Misc. No.65659 of 2018 (2) dt.05-11-2018 2/2 eye witness of the occurrence. Petitioner is daily wage labourer. The altercation took place for payment of wages, on account of which, the instant case has been lodged. Counsel for the petitioner further submits that petitioner is in custody since 24.05.2018. He has clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-VI-cumAdditional Chief Judicial Magistrate, Muzaffarpur, in connection with Mushahari P.S. Case No. 115 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
