The petitioner seeks bail in Aurangabad Muffasil P.S. Case No. 164/2016, registered for the offences punishable under Sections 8/20(b)(II)(c) of the NDPS Act.

The informant on information intercepted pick-up van bearing Registration No. BR 04M 0561 and on search besides Rs. 2,70,000/- cash, 898kg ganja was recovered.

Sri Rama Kant Sharma, learned senior counsel for the petitioner submits that the petitioner is the cleaner of the pick-up van and he was simply going on the pick-up van without knowing the fact that what was loaded on the pick-up van, but on perusal of the FIR itself, it appears that four persons including the petitioner were apprehended and on search huge quantity i.e. 898kg ganja

Patna High Court Cr.Misc. No.11190 of 2017 (2) dt.10-03-2017 2/2 was recovered from the vehicle which was being carried by the petitioner and others.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same, if possible, within one year from the date of receipt of a copy of this order.
