The petitioner seeks bail in Patepur P. S. Case No. 56 of 2018 instituted for the offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that police, on suspicion, during course of search of motorcycle, tried to stop one of the motorcycle. It is further alleged that two persons coming on the aforesaid motorcycle were apprehended. On interrogation, they told their name as Sikendra Kumar Sahani (petitioner) and Vikky Kumar. They could not produce valid paper of the motorcycle. Thereafter, police prepared the seizure list. It is further alleged that petitioner told that some stolen motorcycles were kept in the house of Jitendra Choudhary.

Patna High Court Cr.Misc. No.68160 of 2018(2) dt.27-11-2018 2/2 Thereafter, police raided the house of Jitendra Choudhary and recovered few motorcycle. Thereafter, police prepared seizure list. It is further alleged that Vikky Kumar confessed the guilt and informed that some stolen motorcycle have been kept in the house of Pankaj Kumar. Thereafter, police raided the house of Pankaj Kumar and prepared seizure list. It is further alleged that co -accused Vikky Kumar further disclosed that stolen motorcycle has been kept by one Vipul Paswan in his house and, on search, a motorcycle was recovered and seizure list was prepared. Seizure list prepared by the police is part of the FIR. But none of the seizure list bears signature of this petitioner. Petitioner is in custody since 14.4.2018 .

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge XI cum ACJM X Vaishali at Hajipur, in connection with Patepur P. S. Case No. 56 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
