The Petitioner seeks bail in Warsaligunj P.S. Case No. 305 of 2016 instituted for the offence under Section(s) 30A of the Bihar Excise(Amendment) Act.
It is alleged that 70 litres of mahua liquor has been recovered from the house of this petitioner. In the seizure list, the father's name of this petitioner has been mentioned as Baso Chaudhary. But, it has been submitted on behalf of the petitioner that Baso Chaudhary is the grand-father of this petitioner and therefore, he is not challenging the identity of this petitioner. Keeping in view the period spent by the petitioner in the custody, prayer of the petitioner for grant of bail
Patna High Court Cr.Misc. No.11034 of 2017 (2) dt.18-03-2017 2/2 is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Nawada in connection with Warsaligunj P.S. Case No. 305 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner will also file an affidavit at the time of release that he will not indulge in such type of activity again in future and in the event, he is found indulging in such activity, the bail bonds of the petitioner will be liable to be cancelled by the Court below.
