JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 Petitioner prays for bail in connection with Rani Talab P.S.Case No. 98 of 2017, corresponding to Sessions Trial No. 447 of 2018, registered for the offences punishable under Sections 304B, 120B and 34 of the Indian Penal Code. Allegation against is of committing death of his wife due to non-fulfilment of demand of dowry.

Submission of learned counsel for the petitioner is that FIR itself shows that she died due to hanging and as such he has falsely been implicated in this case. Further submission is that now trial has commenced and informant and mother of deceased have been examined and both of them have been declared hostile by the prosecution as they have not supported the prosecution case and evidence of informant has been annexed as Annexure-3 to this petition and petitioner is in

Patna High Court Cr.Misc. No.65252 of 2018(2) dt.06-11-2018 2/2 custody since 23.1.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-VII, Danapur, Patna, in connection with Rani Talab P.S.Case No. 98 of 2017, corresponding to Sessions Trial No. 447 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
