The petitioner apprehends his arrest in Complaint case No. 3275 of 2015 under Section 420, 467, 468, 471/34 of the Indian Penal Code.
The complainant alleged that the accused persons persuaded her to purchase a piece of land and that she got the sale deed executed but while she was constructing boundary wall somebody else raised objection and during enquiry it transpired that the accused showed false and fabricated documents of title with regard to land.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.10568 of 2017 (2) dt.16-03-2017 2/2 petitioner is son-in-law of accused No.1 Sk. Md. Alam and he is only witness of the sale deed. The petitioner never persuaded the complainant to purchase the land.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in C.A. No. 3275 of 2015, Tr. No. 2526 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
