The petitioner is in custody since 24.08.2019 in connection with G.R. No. 994 of 2019 arising out of Simra P.S. Case No. 36 of 2019 for the offence registered under Section 414 of the Indian Penal Code and Section 30 (a) and 37 (b) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the motorcycle with which the petitioner has no concern.
