The petitioner seeks bail in Mufassil P.S. Case No. 138/2016, registered for the offences punishable under Sections 498(A), 365 and other Sections of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Later on Section 304B and other Sections of the Indian Penal Code were added. The petitioner is father-in-law of the deceased. The informant alleged that he married his sister with Tunnu Yadav, son of the petitioner, four years ago. When the informant came to the house of the petitioner, his sister was not found. The villagers stated that his sister has gone with Tunnu Yadav on cycle, who is still traceless.

Learned counsel for the petitioner submits that there is

Patna High Court Cr.Misc. No.11010 of 2017 (2) dt.07-03-2017 2/2 no specific allegation against the petitioner. The petitioner and others were earlier filed petition for grant of anticipatory bail in Cr. Misc. No. 28506/2016 and Cr. Misc. No. 37129/2016. All the accused persons were granted anticipatory bail vide order dated 03.10.2016 passed in the aforesaid case, but since the petitioner was arrested, his prayer for anticipatory bail was dismissed as withdrawn.

Considering the facts aforesaid and the fact that the petitioner is in jail since 01.09.2016 and no specific allegation is made against him, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Mufassil P.S.
