2. The petitioner apprehends arrest in connection with Muffasil P.S. Case No. 454 of 2025 dated 17.05.2025, instituted for the offence punishable under Sections 191(2), 190, 121(1), 122(2), 109, 132, 262, 324(4), 324(5), 352 and 125 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that on 17.05.2025, after getting secret information, the informant along with his team went to the place of occurrence and apprehended one person namely, Anil Sharma, who disclosed that he bought the stolen tractor from one Lalan Paswan. Anil Sharma sold the same tractor to Shubham Kumar. Thereafter, on the information of Anil Sharma, one Mahindra Tractor was found near hill and
Patna High Court CR. MISC. No.70932 of 2025(2) dt.08-10-2025 2/3 Shubham Kumar was arrested, who did not produce any document of the tractor. It is further alleged that when the police moved with the apprehended persons and tractor, in the way, 1520 miscreants came on motorcycle and attacked the police and succeeded in getting the accused person flee from the clutches of police. In this incident, police personnel sustained injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the FIR has been lodged against 9 accused persons including the petitioner and 10-15 unknown persons. There is no specific allegation against the petitioner rather the allegation levelled against the petitioner is general and omnibus in nature. It is next submitted that petitioner has no concern with the alleged occurrence, he was only member of the mob. It is further submitted that nothing has been recovered either from the conscious possession or from the house of the petitioner. Lastly, it has been submitted that petitioner has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in
Patna High Court CR. MISC. No.70932 of 2025(2) dt.08-10-2025 3/3 the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Muffasil P.S. Case No. 454 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, subject to condition as laid down under Section 482(2) of the B.N.S.S.
