The petitioner seeks bail in Bakhri P.S. Case No. 172/2016, registered for the offences punishable under Section 290 of the Indian Penal Code and sections 47(A) and 57(A) of the Excise Act, 2016.

The police intercepted a pick-up van, but two persons managed to flee away from the pick-up van. On search, 231 litres of different brands of foreign liquor was recovered from the pickup van. Learned counsel for the petitioner submits that the petitioner is driver of the vehicle. The owner of the vehicle has already been granted anticipatory bail. The petitioner is in jail since 21.09.2016.

Patna High Court Cr.Misc. No.12440 of 2017 (2) dt.22-03-2017 Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than six months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Begusarai in connection with Bakhri P.S. Case No. 172/2016.
