JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chiraiya P.S. Case No.41 of 2016 instituted for the offence under Sections 364, 302, 201 and 120B/34 of the Indian Penal Code.

It is alleged in the written report that husband of the informant has truck and he used to drive the same himself. The informant talked with her husband on his mobile who told her that he is with Binod Mahto and Manoj Mahto and he will return in the night. Thereafter, the mobile phone of her husband was switched off and informant was not able to talk with her husband further. She has apprehension that her husband was kidnapped by the petitioner and Kamta Pandey along with Binod Mahto. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.11085 of 2017 (2) dt.18-03-2017 2/2 Manoj Mahto has been granted bail by a coordinate Bench of this Court vide order dated 8.12.2016 passed in Cr. Misc. 53214 of 2016.

From the written report it appears that mere suspicion has been raised against the petitioner. From the impugned order also it appears that mere suspicion has been raised against the petitioner in the case diary. The petitioner is said to be in custody since 1.10.2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sikrahna at Dhaka, East Champaran, in connection with Chiraiya P.S. Case No. 41 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
