2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.
3. As per prosecution case, a dead body of unknown person was recovered and it appeared that he had been strangulated to death and his body was thrown in the bush by the side of the road to hide the same.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no eye witness of the occurrence. Charge sheet has already been submitted. Petitioner is in custody since 2.7.2025.
5. Learned counsel for the State opposes the prayer for bail. He submits that during investigation nephew of the
Patna High Court CR. MISC. No.68358 of 2025(4) dt.09-12-2025 2/2 deceased has made confession stating that it was the petitioner and co-accused Mithun Kumar who had called and taken the deceased. Witnesses in paragraphs 39, 40 and 41 of the case diary, have stated that due to previous dispute, petitioner and his brother and other accused persons offered excessive alcohol to the deceased and then strangulated him to death and threw the dead body in the bush.
6. Considering the gravity of accusation as well as the materials collected during course of investigation, petition for bail of this petitioner is dismissed. Since, petitioner is in custody, let the trial be expedited and concluded preferably within a year.
