JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Athmalgola P.S. Case No. 47 of 2019, registered for the offences punishable under Sections 147, 341, 323, 504, 379, 354, 448, 307 and 34 of the Indian Penal Code. As per F.I.R. petitioners and other co-accused persons assaulted the informant. Specific allegation against one coaccused Chottu Pandey assaulted by rod to the informant. Submission of the learned counsel for the petitioners is that they have been safely implicated in this case due to village disputes and there is no specific injury. Allegation of assault is not attributed against any of the petitioners and they are ready to abide by any condition imposed on them.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Barh, Patna in connection with Athmalgola P.S. Case No.-47 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
