JUSTICE SUDHIR SINGH ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 290/34 of the I.P.C. and Sections 3(i), 3(2), 4, 5, 6, 7 of the Immoral Traffic Act.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application with observation 'at this stage'. This is second attempt for grant of regular bail.

A report was called for from the trial court regarding the stage of the trial. It is reported that charge has not been framed. It has been reported further that after framing of charge it will take six months time to conclude the trial. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.13003 of 2017 (4) dt.26-04-2017 2/2 the petitioner is in custody since 01.04.2016. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The Section of Immoral Traffic Act is not made out against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Agamkuan P.S. case No.108 of 2016.
