JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2017 The petitioner is apprehending his arrest in connection with Azamnagar P.S. Case No. 283 of 2016, registered for the offences punishable under Sections 376, 506, 504/34 of the Indian Penal Code and Section 4 of the POCSO Act.
It has been submitted on behalf of the petitioner that nothing incriminating has been found against the petitioner in the case diary nor any villager has seen the occurrence and the petitioner has been falsely implicated in this case. Learned counsel for the petitioner has also pointed out that the victim is already married.
Heard learned A.P.P. who has opposed the prayer for bail.
Having heard both sides and in view of direct allegation
Patna High Court Cr.Misc. No.12530 of 2017 (4) dt.26-04-2017 2/2 levelled against the petitioner and the mother of the victim is also eye witness, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
Let the petitioner surrender before the court below and make prayer for regular bail, which would be considered on its own merit, without being prejudiced by anything said in this order. (Vinod Kumar Sinha, J) Ranjan/- U
