JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-10-2024 This application has been filed for modification of the order dated 30.08.2023 passed in Cr.Misc.No.46889 of 2023 by which the petitioner was granted pre-arrest bail.

2. Learned counsel for the petitioner submits that the petitioner could not surrender in the learned court below within the prescribed period because he was suffering from Dengue.

3. Having regard to the submission that the petitioner could not surrender in the learned court below within the prescribed period because he was suffering from Dengue and in this regard he has placed on the record a copy of the medical prescription dated 26.09.2023 as Annexure- '2' to the present petition, this Court extends the period.

4. Let the petitioner surrender within a period of three

Patna High Court CR. MISC. No.30820 of 2024(2) dt.05-10-2024 2/2 weeks from today in the learned court below and submit the bail bonds in terms of the order dated 30.08.2023 passed in Cr.Misc.No.46889 of 2023. If he does so, the learned court below shall give the benefit of the order of this Court.
