2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 123 and 3(5) of B.N.S., 2023.
3. The case of the prosecution, in short, is that one Babita Kumari was married to this petitioner 12 years ago. It is alleged that the in-laws of the deceased used to subject her to cruelty. It is also alleged that the petitioner is a drunkard. It is alleged that when the deceased objected the selling of land, she was being assaulted badly and administered poison to her.
4. Learned counsel for the petitioner has submitted that from perusal of the post-mortem report, it is clear that the doctor has not found any external injury on any part of the body
Patna High Court CR. MISC. No.71917 of 2025(2) dt.14-10-2025 2/2 of the deceased rather viscera was reserved and the same was sent to FSL for forensic examination. It is further submitted that there is allegation that the petitioner and his family members have assaulted the deceased badly. It has also been submitted that charge-sheet has already been submitted.
5. Learned APP for the State vehemently opposed the bail application.
6. Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-V, Jamui in connection with Sono P.S. Case No.375 of 2024.
