The petitioner seeks bail in Kahalgaon N.T.P.C. P.S. Case No. 31 of 2016 registered under Sections 188 and 290 of the Indian Penal Code and Section 30(a) of the Bihar Excise (Amendment) Act, 2016 Two persons, namely, Shailesh Kuamr and Amit Kuamr (the petitioner) were apprehended and from possession of both the accused, 19 bottles each containing 75 ML of Royal Stag and 48 bottles each containing 180ML Macdowell were recovered. One motorcycle was also recovered.

It is submitted that for that the petitioner is in jail since 04.12.2016. The petitioner has already remained in jail for

Patna High Court Cr.Misc. No.11867 of 2017 (2) dt.18-03-2017 2/2 three months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kahalgaon N.T.P.C. P.S. Case No. 31 of 2016.
