1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant, Ms. Shalini.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 118(1), 109, 352, 351(2), 303(2) of the BNS and later on Section 103 of BNS has been added.

No.71926 of 2025(3) dt.26-02-2026 2/3 petitioner submits that petitioner is a person with clean antecedent and is in judicial custody since 03.03.2025 and the informant (Laxmi Devi) alleges that on 25.02.2025, all the FIR named accused persons including the petitioner along with 1015 unknown accused came variously armed and assaulted her son and when the family members came to save her son, the husband of the informant was also assaulted and the husband of the informant subsequently died during the course of treatment.

Learned counsel for the petitioner submits that Arun Kumar had approached this Court seeking regular bail by filing Criminal Miscellaneous No. 79842 of 2025 and the same was allowed by an order dated 26.11.2025 passed by a learned Co-ordinate Bench, as such, the instant regular bail application has been filed seeking bail based on parity, on which the learned counsel appearing on behalf of the informant submits that case of the petitioner and Arun Kumar is not similar. It is next submitted by the learned counsel appearing on behalf of the informant that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that while her son was playing outside the house when petitioner came along with other accused persons and started assaulting him and when her husband and other family members came to save him, this

No.71926 of 2025(3) dt.26-02-2026 3/3 petitioner assaulted her husband by an iron rod causing injury on head and her husband died during the course of treatment, it is thus submitted that there is specific allegation against this petitioner of assaulting the son and husband of the informant.

5. After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail.

6. Accordingly, the instant bail application stands rejected.
