JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-04-2017 The petitioner is apprehending his arrest in connection with Kotwali (Adampur) P.S. Case No. 697 of 2016, registered for offences punishable under Sections 409, 420, 468, 469, 471 and 120(B) of the Indian Penal Code. It has been submitted on behalf of the petitioner that allegation against the petitioner that he secured appointment on the basis of forged document, however, at the time of appointment all his documents were duly verified by the authorities concerned. Moreover, the petitioner has already left the said job and is ready to pay whatever amount that has been withdrawn by him as salary. It has further been submitted that other similarly situated person has already been granted the privilege of anticipatory bail by this Court vide order dated 23.02.2017 passed in Criminal

Patna High Court Cr.Misc. No.14881 of 2017 (2) dt.06-04-2017 2/2 Miscellaneous No. 8094 of 2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that now the petitioner has already left the job and whatever amount that has been paid to him as salary, he is ready to return the same and other similarly situated persons has already been granted bail and as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No. 697/16, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that petitioner will have to return entire government amount, which the petitioner realized during her service period, within a period of twelve months.
