The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 307/34 fo the Indian Penal Code, Section 27 of the Arms Act and Section 30, 30(a) of the Bihar Prohibition and Excise Act. Prosecution case relates to recovery of total 2499 liters country made foreign liquor of different brands from a truck and a vehicle of Force Company.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. It is further submitted that the petitioner has no concern with the alleged recovery of illicit liquor or with the vehicles in question from where the recover has been made. Neither the petitioner

Patna High Court CR. MISC. No.71440 of 2022(2) dt.06-01-2023 2/2 was arrested on spot nor any incriminating article has been recovered from his conscious possession. The name of the petitioner has been disclosed in this case on the confession made by the co-accused namely, Dharmedra Das. Similarly situated co-accused namely, Satrudhan Singh has already been granted by a co-ordinate bench of this court vide order dated 20.10.2020 in Cr. Misc. No. 27404 of 2020. The petitioner is languishing in judicial custody since 23.8.2022.

Learned APP appearing for the State has vehemently opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Paroo P.S. Case No. 467 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act (Excise court No-II), Muzaffarpur.
