The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 411, 413 of the Indian Penal Code.
It is alleged that a truck was seized with illegally loaded 650 CFT sand and after seeing the raiding team, the petitioner, who is owner-cum-driver of the seized truck, fled away from spot causing thereby revenue loss of Rs. 2,34,938/-. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Petitioner was carrying 600 CFT sand with valid challan issued in his favour by Sri Satya Sai Technocrates Pvt. (Annexure 2). In the F.I.R., the quantity of sand has been wrongly shown to be 650 CFT instead of 600 CFT.
Patna High Court CR. MISC. No.69008 of 2022(6) dt.24-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Nawada (Kadirganj O.P.)
