2. The petitioner has preferred this application for grant of regular bail in connection with Konch P.S. Case No. 269 of 2025 registered for the offences punishable under Sections 96 and 64 of the B.N.S. and Sections 4 & 6 of the POCSO Act.

3. As per the prosecution case, the petitioner and the co-accused person are alleged to have kidnapped the informant's niece, aged about 13 years on the pretext of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

It has further been submitted that the statement of the victim girl was recorded under Section 183 of the B.N.S.S., wherein she has stated that she was in love with the petitioner and she was not kidnapped rather she had gone out of her own sweet will. It is further submitted that the victim was not forced or seduced to have illicit intercourse with another person. It is further submitted that as per the medical report the age of the victim girl is in between 16-17 years and there is no definite evidence of recent sexual intercourse. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya, in connection with Konch P.S. Case No. 269 of 2025, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the
