====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-06-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.
Petitioner along with other F.I.R. named accused persons is alleged to have misappropriated Rs. 3,67,900/- of L&T Financial Services Company.
Learned counsel appearing for the petitioner submits that from perusal of the F.I.R. itself, it is clear that petitioner was posted as Field Lever Officer in the said company and his responsibility was to reach out to the people who were in need of the loan amount, collect their documents and upload the same on the site of the company. It was not the duty of the petitioner
Patna High Court CR. MISC. No.71199 of 2022(4) dt.22-06-2023 2/2 to disburse the sanctioned loan amount and as such, he cannot be held responsible for the illegal disbursement of the said loan amount. Petitioner has got clean antecedent.
Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah at West Champaran in connection with Shikarpur P. S. Case No. 345 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
