Petitioner, who is in custody, seeks bail in connection with Revilganj P.S. Case No. 16 of 2018 (G.R. No. 423 of 2018) registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code. Allegation against petitioner is recovery of one loaded country made Katta with one live cartridge from the waist and two live cartridge from the pocket of the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner was not apprehended at the place of occurrence. Nothing has been recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.67298 of 2018(2) dt.26-11-2018 2/2 He is in custody since 19.01.2018. It has been further submitted that similarly placed co-accused has been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 48451 of 2018 vide order dated 24.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -VIII, Saran in connection with Revilganj P.S.
