Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sahebganj P.S. Case No. 281 of 2018 instituted for the offence under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act, Sections 8, 20(b), (II), (B) of NDPS Act. Counsel for the petitioner submits that petitioner has not been apprehended on spot. No Test Identification Parade has been held. Counsel for the petitioner further submits that petitioner has been implicated in this case on the statement of co-accused Mukesh Kumar. He has disclosed the name of this petitioner before the police.

Patna High Court Cr.Misc. No.67783 of 2018(2) dt.26-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur, in connection with Sahebganj P.S. Case No. 281 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
