1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Tariyani (Tariynai) P.S Case no. 269 of 2021 registered under sections 30(a), 30(b), 30(c) of the Bihar Prohibition and Excise Amendment Act, 2016.

3. As per the prosecution case, the informant states that as a result of raids being conducted at the house of different co-accused persons a total of 195 litres of semi-finished liquor was recovered from the house of six accused persons, which included 30 litres from the house of the petitioner. It is further stated that Mahua solution in the process of manufacture of liquor was recovered from elsewhere.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.73873 of 2023(2) dt.29-11-2023 2/2 that the petitioner has been falsely implicated in the case. Contrary to the allegation of recovery of 30 litres of semi finished liquor, no incriminating article has been recovered from the petitioner's house. The petitioner has no criminal antecedent. He is in custody since 17.8.2023 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the petitioner being in custody since 17.8.2023, charge-sheet having been submitted in the case and especially his not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Tariyani (Tariynai) P.S Case no. 269 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Sheohar.
