The petitioner apprehends his arrest in connection with Salkhua (Banma Itahari O.P) P.S. Case no. 162 of 2018, registered under Section 341, 323, 324, 307, 308, 379 and 504/34 of the Indian Penal Code.
The accusation is that on 25.07.2018 at about 10.00 P.M. while informant Sujit Kumar Choudhary was going to sleep, at that time, five persons named in the F.I.R., including the petitioner came there and asked about his parents then he replied that he has no knowledge. Thereafter, petitioner gave Dabiya blow causing blood oozing injury at his head and he fell down. Patna High Court CR. MISC. No.64086 of 2019(2) dt.21-10-2019 2/2 by Pappu Choudhary, whereas Balo Choudhary started causing assault though lathi. At that time, Dinesh Choudhary, Balo Choudhary and Sanjay @ Rinku took gold chain of informant worth of Rs. 16,000/- and other articles worth of Rs. 50,000/-. Learned counsel for the petitioner submits that while allegation has been made against the petitioner to cause injury on the person of informant, but the injury as found on the person of informant is simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV, Saharsa in connection with Salkhua (Banma Itahari O.P) P.S. Case No. 162 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
