The petitioner seeks pre-arrest bail in connection with Narpatganj P.S. Case No. 90 of 2019 registered under Sections 354C, 354 and 504 of the Indian Penal Code and 66 of the Information Technology Act, 2000.

The accusation is of posting of objectionable photographs of the daughter of the informant on Whats App group and Face Book by the petitioner.

The learned counsel appearing on behalf of the petitioner submits that in fact the present case has been lodged due to misunderstanding of the informant. Later on, about realizing the misunderstanding, the informant and his daughter filed an application for disposal of the case, on the basis of compromise petition entered into between the parties, in the

Patna High Court CR. MISC. No.63977 of 2019(2) dt.18-10-2019 2/2 Court of the Chief Judicial Magistrate, Araria, which would appear from Annexure 2.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Narpatganj P.S. Case No. 90 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
