The petitioners seek bail in anticipation of their arrest in connection with Nautan (Jagdishpur) P.S. Case No. 256 of 2018, dated 21.05.2018, instituted for the offences
Patna High Court Cr.Misc. No.66543 of 2018(2) dt.14-12-2018 2/3 under Sections 341, 448, 323, 380, 384, 387 and 452/34 of the I.P.C.
The informant/Raj Kishore Prasad has alleged that the petitioners, who are related to each other, came inside his nursing home and took away the computer peripherals worth Rs. 20,000/-. The signature of the informant was also obtained on gun point on a blank piece of paper. The petitioners have a different story to narrate. The petitioner No. 1 worked as a nurse in the clinic of the informant of the present case. On the same day, when the subject F.I.R. was lodged, the petitioner No. 1 also has filed a case vide Nautan (Jagdishpur) P.S. Case No. 257 of 2018 against the informant of the present case under Sections 341, 323, 354B, 376, 504 and 506/34 of the I.P.C. and Section 3(i)(h)(r)w(II) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. There are two versions of the occurrence and it appears that with respect to same dispute between the proprietor of the nursing home and the nurse, two cases have been filed.

No.66543 of 2018(2) dt.14-12-2018 3/3 Regard being had to the background facts and the clean antecedent of the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan (Jagdishpur) P.S. Case No. 256 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
