The petitioner seeks bail in connection with Nalanda Excise Case No. 184C3 Ex/2018 instituted for the offence under Section(s) 30(a) of the Bihar Excise Act.

It is alleged that total 124.500 litres of foreign liquor has been recovered from a car. The petitioner was arrested on the spot being the driver of the aforesaid car. Learned counsel for the petitioner has submitted that petitioner was not the owner of the car. He was merely driver of the aforesaid car.

The petitioner is in custody since 4.9.2018 having clean antecedent

Patna High Court Cr.Misc. No.68631 of 2018(2) dt.29-11-2018 2/2 Keeping in view the clean antecedent of the petitioner and the period of custody already spent by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Nalanda at Bihar Sharif in connection with Nalanda Excise Case No. 184C3 Ex/2018, subject to the condition that both the bailers shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond will be liable to be cancelled.
