This application for anticipatory bail arises out of Town P.S. Case No. 158 of 2018 disclosing offences under Sections 363, 366 and 34 of the Indian Penal Code. At the very outset, learned counsel for the petitioners informs that petitioner No. 1 has been arrested during the pendency of this application and this application to that extent has become infructuous. Accordingly, this application to the extent it relates to the petitioner No. 1, stands dismissed as having become infructuous.

Upon perusal of the FIR, I notice that the main allegation is against petitioner No. 1, who is said to have played

Patna High Court Cr.Misc. No.69552 of 2018(2) dt.17-12-2018 2/2 some role in kidnapping the victim. There is no allegation of specific overt act against petitioner No. 2, save and except an allegation that he had threatened the informant with dire consequences.

Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Town P.S. Case No. 158 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
