The petitioner apprehends his arrest in Complaint Case No. 2337 of 2015 registered for the offences punishable under Sections 323 and 354 of the Indian Penal Code. The complainant alleged that the petitioner put her down on the ground and assaulted her. The occurrence took place on 02.08.2015 but the complaint petition was filed on 05.08.2015. Learned counsel for the petitioner submits that the petitioner is the son of the brother of the husband of the complainant. On account of some petty family dispute this false case has been lodged.
Considering the facts aforesaid and the fact that the
Patna High Court Cr.Misc. No.14079 of 2017 (2) dt.25-05-2017 2/2 petitioner is non-else than son of the brother of the husband of the complainant and the complainant is aunt of the petitioner, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Gopalganj in Complaint Case No. 2337 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
