The petitioner seeks bail in connection with Bihpur P.S. Case No. 364 of 2018 instituted for the offence under Section(s) 30(a)/38(i) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioner has submitted that recovery has been made from Bolero vehicle which is alleged to be registered in the name of one Subodh Choudhary. The driver of the aforesaid vehicle was Pradeep Sonkar. The petitioner was only found sitting on the aforesaid vehicle. He has no concern with the aforesaid illicit foreign liquor.
Patna High Court Cr.Misc. No.67217 of 2018(2) dt.26-11-2018 2/2 From the seizure list ,which is part of the FIR, it appears that total 828 litres of illicit foreign liquor has been recovered from the aforesaid vehicle.
The petitioner is in custody since 11.9.2018 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge(Excise Act), Bhagalpur, in connection with Bihpur Police Station Case No. 364 of 2018, G.R. No. 4983 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U
