====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-12-2018 A supplementary affidavit has been filed on behalf of petitioners. The same may be kept on the record. Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in a case for the offence registered under Sections 341, 323, 504, 506 and 307/34 of the IPC.

The prosecution story, in brief, is that on 23.02.2018 at 7.00 A.M., the informant was covering with Tat of Fus at her door. In the meantime, petitioners came and started abusing. On protest, petitioners started assaulting her with slaps and fists. Due to assault and pain in her stomach, she fell down on the ground. The informant was pregnant. Thereafter, nearby people

Patna High Court Cr.Misc. No.66236 of 2018(2) dt.17-12-2018 2/3 came there and pacified the quarrel. Petitioners threatened the informant to go anywhere whatever she wanted. The motive behind the occurrence is said to be land dispute. It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. From perusal of the injury report and other reports annexed to the supplementary affidavit filed by the petitioners, it appears that the injury is said to be normal. No offence under Section 307 of the IPC is made out.

On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Purnea, in connection with Tikapatti P.S. Case No. 21 of
