2. The petitioner seeks regular bail in connection with Shekhpura P.S. Case No.428 of 2023 lodged under Section 392 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against unknown accused persons against whom there is allegation of robbery of Pan card, ATM card, Adhaar card and passport from the bag of informant.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner's name has figured in this case by virtue of confessional statement of other accused persons. He further submits that nothing incriminating has been recovered from the possession of the petitioner nor he was put on T.I.P.

5. Learned Counsel further submits that his name has been inserted in one case and subsequently, after lodging of

Patna High Court CR. MISC. No.72892 of 2024(3) dt.05-02-2025 2/2 present case, his name has been inserted in 3 more cases, which are pending against him.

6. Learned Counsel further submits that the petitioner is in custody since 19.08.2023 having three antecedent. He further submits that offence under section 392 of the I.P.C. has been alleged against the petitioner, which is magisterial triable in nature.

7. Counsel also submits that a similarly situated person has been granted bail by this Court vide order dated 07.02.2024 passed in Cr. Misc. No. 5318/2024.

8. Learned counsel for the State opposes the prayer for bail.

9. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, but only after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Shekhpura in connection with Shekhpura P.S. Case No.428 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
