The petitioner seeks bail in connection with Gaighat P.S. Case No.278 of 2010 (Sessions Trial No.88 of 2017) registered under Sections 364/34 of the Indian Penal Code.

The accusation is that this petitioner and five other F.I.R. named accused accompanied Ram Lala Thakur, the son of the informant Niteshwar Thakur, to Delhi for providing the job. While all the accused returned to their house but Ram Lala Thakur, the son of the informant, and one Sunil Sahni did not return. On query, they did not give satisfactory reply regarding the son of the informant. The informant raised suspicion about committing murder of his son by them.

No.12879 of 2017 (4) dt.10-05-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the son of the informant was accompanied by Sunil Sahni and his two brothers, namely, Dinesh Sahni and Mahesh Sahni but the petitioner and two others have also been falsely implicated in this case. In paragraphs-45 and 46 of the case diary, the witnesses have also stated about accompanying the son of the informant by Sunil Sahni and his two brothers. The petitioner having no criminal antecedent is in custody since 02.10.2016. Further submission is that the similarly situated co-accused Kari Sahani alias Binod Sahani has already been granted bail by this Court vide order dated 19.05.2016 passed in Criminal Misc. No.20823 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Muzaffarpur, in connection with Gaighat P.S. Case No.278 of 2010(Sessions Trial No.88 of 2017). (Rajendra Kumar Mishra, J) P.S./- U T
