ANJANA MISHRA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Dehri (Dalmiyanagar) P.S. Case No.481 of 2018 for allegedly having committed the offence under Sections 400, 401, 411 and 414 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner has been named in the FIR on the basis of the confessional statement made before the police by one Kallu Khan @ Firoz Khan, there has been no recovery from the conscious possession of the petitioner. It is further submitted that the said Kallu Khan @ Firoz Khan is having some enmity between himself and the brother of the petitioner, namely, Bundel Singh @ Dharmendra Kumar

Patna High Court Cr.Misc. No.66026 of 2018(2) dt.19-12-2018 2/2 Singh, and so far as the present petitioner is concerned, he has already separated from his brother and has nothing to do with the affairs of his brother.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram, in connection with Dehri (Dalmiyanagar) P.S. Case No.481 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
