1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barabar Prayatan (Barabar Prayatack) P.S. Case no.100 of 2023 registered under sections 414, 420, 467, 468 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that on receiving information about the petitioner having kept a stolen motorcycle in his house, a raid was conducted. The stolen motorcycle was recovered for which the petitioner did not produce any documents and in fact stated that he had purchased the said stolen motorcycle from co-accused Biru Kumar for Rs.7000/-.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He had genuinely purchased the said motorcycle without knowing the

Patna High Court CR. MISC. No.73858 of 2023(2) dt.29-11-2023 2/2 fact that it is stolen. The petitioner is in custody since 1.8.2023 and has no antecedent of similar nature.

5. The prayer for bail is opposed by learned A.P.P for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, his being in custody for about 4 months since 1.8.2023, not having any antecedent of similar nature and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Barabar Prayatan (Barabar Prayatack) P.S. Case no.100 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jehanabad.
