The petitioner apprehends his arrest in connection with Ghanshyampur P.S. Case No. 82 of 2016, registered under Sections 147, 149, 341, 323, 324, 307 and 447 of the Indian Penal Code.
The accusation is that 12 persons named in the F.I.R. including the petitioner came at the door of the informant variously armed with weapons and started to cause assault to him. At that time, Santosh Sharma caused injury at the head of informant through Khanti whereas this petitioner caused injury near the eye and head of Bahuran Sharma through knife. In the meantime, Nago Sharma caused injury at the back of Nirmala

Learned counsel for the petitioner submits that occurrence took place due to land dispute, in which, petitioner's side also sustained injury, regarding which, Ghanshyampur P.S. Case No. 81 of 2016 was also instituted on the basis of written report of Binda Devi, mother of co-accused, Anil Sharma. Moreover, the injury as found on the person of the Bahuran Sharma, which is said to be caused by this petitioner, is simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Ghanshyampur P.S. Case No. 82 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
